Terms and Conditions of Coach Hire (Updated February 24)

 

Laguna Travel is the trading name of Laguna Travel Ltd (registration number 11871029), hereafter, the Company. The following conditions apply whether a contract has been made verbally or in writing. The hirer acts on behalf of all passengers travelling on the vehicle. If the hirer is a company or group, an individual must be named as a responsible person and the Company will only accept instructions from the hirer.

Payment – the balance of payment is due 14 days before the date of the hire unless the Company has provided written consent to modify this condition. In the case of payment through bank transfer, we request notification upon completion of the transaction.

Use of the Vehicle - The Company advises on journey times in good faith. Any distances or travel times expressed by the Company assume the most direct route and normal road and weather conditions. No liability can be accepted by the Company for unforeseen circumstances that alter route or journey times.

Route - Unless the Hirer has advised of a particular route of places to be passed on route, the route will be at the discretion of the Company and/or the driver. The Company does not guarantee to complete any journey in any given time and will not be accountable for any loss or inconvenience which may arise from the delay or detention of any vehicle arising from any cause whatsoever. Should a vehicle be detained by the Hirer or be taken on a longer journey than contracted for, the Company reserves the right to make a proportional additional charge. Unless stated it should not be assumed that any vehicle will remain at the destination until the time for the return journey.

Fuel Surcharge- If there is a significant national fuel price increase we may have to amend the cost post quotation to reflect the increase, we will take all reasonable steps to inform you of any increase before travel, there will be no penalty if you cancel the booking as a result.

Cancellation - There is no cancellation fee if a booking is cancelled within a reasonable period, however if cancelled within 24 hours of departure the cost will be £115. Where the vehicle has been despatched and is not required we will charge £1.50 per mile travelled for the vehicle cost in addition to the £115 standing charge. Cancellation due to inclement weather conditions by the client will be chargeable as detailed above, including termination part-way through a journey due to inclement weather by the client or Company/Driver. All arrangements for hotel accommodation, meal, theatre tickets, sea or tunnel journeys or any other item/service made by the Company as agents for or on behalf of the Hirer, on the express condition that the Company shall not be responsible for any loss, damage or delay or inconvenience caused to passengers as a result of any arrangements. These arrangements are also made under the conditions of supply by the suppliers.

Cancellation by company - In the event of an emergency and/or an action by the Hirer to vary the agreed conditions, the Company may return all monies paid and without further liability cancel the Contract.

Supply of vehicle - The Company may provide a larger vehicle than the size hired at no additional charge. The Company reserves the right to hire another Coach Operator to cover the hire. Unless stated it should not be assumed that any vehicle will remain at the destination until time for the return journey.

Drivers hours & rest periods - The Driver’s hours, driving & rest periods are strictly controlled and current regulations must be complied with. The Company will agree in advance hours of operation of the hire and these MUST be observed.

Seating Capacity - The maximum number of passengers allowed on the vehicle is indicated on the vehicle. No standing passengers are allowed. Drivers will not carry any extra passengers over the seating capacity of the vehicle.

Animals - will not be carried on any vehicle, except Assistance Dogs.

Variation of hire - If the vehicle is detained late by the Hirer or used for a longer journey than that contracted for, the Company may make an extra charge.

Conduct of passengers -  The Driver is responsible for the safety of the vehicle. Any passengers whose conduct is in breach of statutory regulations will be removed on the Driver’s authority. The Hirer will be responsible for all damages caused to the vehicle by passengers during the hiring.

Property -  The Company will not accept liability for any damage or loss of any property, which belongs to any passengers and is left on a vehicle. Any articles of found property recovered from a vehicle will be held at the Depot from where the vehicle is based and may be collected from there.

Breakdown/delay - The Company gives advice on journey times in good faith, but does not guarantee the completion of a journey at a specific time and will NOT be liable for inconvenience or loss caused by breakdown or delay.

Agency Agreement - When the Company provides meals, accommodation, ferries, admission tickets and any other service provided by another Contractor, it does so as an Agent of the Hirer on his behalf. Any terms and conditions imposed by the Contractor will be binding on the Hirer as if he had directly contracted the services himself.

Alcohol & Food - Under no circumstances may alcoholic drinks be carried on or consumed upon the vehicle without the express permission of the Company in writing. A refundable deposit is required when hiring a coach to a destination where alcohol is likely to be consumed. We do not permit hot food items to be consumed on our vehicles. Any other food items wishing to be brought on to the coach must be given prior authorisation.

Music Events, Festivals, Sporting events - We require a security deposit to be paid prior to the date of the event. The security deposit amount will be £150.00 & will be fully refunded within 5 days if the coach is left in a satisfactory condition. Please note that this is a standard practice for all coach hire going to events where alcohol will be consumed & is in place to protect both parties.

We would require the security deposit to be paid two weeks prior to the event when the coach hire payment is also due.

Smoking - All coaches are strictly non-smoking, this includes e-cigarettes and Vapes.

Complaints - In the event of a complaint about the Company’s services, the hirer should endeavour to seek a solution at the time by gaining assistance from the driver or Company. If this has not provided a remedy, complaints should be submitted in writing within 14 days of the termination date of hire to Laguna Travel Ltd, Suffolk Road South, Bournemouth, BH2 6AZ. The Company will aim to resolve any complaint with 14 days of it being made.
